           कोरोना की चुनौती के बीच 25 अगस्त 2020 से परिवार पहचान पत्र बनायेंगे 𝐒𝐈𝐌 (𝐀𝐌-𝐌𝐈𝐒)

⏩ सभी विद्यालय मुखिया आज सायं तक दिनांक 22.08.2020 तक 25 अगस्त से 2 सितम्बर तक प्रतिदिन प्रात: 8 बजे से सायं 5 बजे तक होने वाली कक्षाओं का schedule सम्बन्धित खण्ड शिक्षा अधिकारी को जमा करवाना सुनिश्चित करेंगे I

⏩ MIS पोर्टल पर जिन भी कर्मचारियों की आई० डी० पर परिवार पहचान पत्र का लिंक आएगा ऐसे सभी कर्मचारियों की सूचि विभाग द्वारा प्राप्त होते ही विद्यालयों को भेज दी जाएगी I

⏩ सभी विद्यालय मुखिया यह सुनिश्चित करेंगे कि कोई भी अभिभावक अपने साथ बच्चों को न लाए I

⏩  परिवार पहचान पत्र का कार्य वरिष्ठ/उच्च विद्यालयों के साथ लगने वाले प्राइमरी विद्यालयों का कार्य भी इन्हीं प्रांगन में होगा I विद्यालय परिसर में जो भी विद्यार्थी एनरोल हैं (चाहे उनकी रिहाईश हरियाणा हो या हरियाणा से बाहर ) सबका डाटा ऑनलाइन करवाना विद्यालय मुखिया की जिम्मेवारी रहेगी I

⏩ विद्यालय मुखिया यह सुनिश्चित करेंगे कि विद्यालय परिसर में एक साथ  20 से अधिक अभिभावक एक स्थान पर एकत्रित न हों I

⏩ निश्चित दूरी की पालना करवाने हेतु प्रतीक्षा वाले स्थान पर दो गज की दूरी पर निशान (Circle) लगाए जाएँ I

⏩ सेनीटाइजर, फेस मास्क, थर्मल स्कैनर और हाथ धोने की समुचित व्यवस्था विद्यालय स्तर पर की जाएगी तथा कंप्यूटर सम्बन्धित कार्य करने वाले कर्मचारी से कुछ दूरी पर रस्सी बंधी होनी चाहिए I

⏩ डॉक्यूमेंट वेरिफिकेशन का कार्य सभी टेक्निकल स्टाफ को छोडकर अन्य स्टाफ सदस्यों द्वारा किया जाना अनिवार्य है I

⏩ 21 वर्ष से ऊपर उम्र के सभी परिवार सदस्यों के लिए वोटर कार्ड संख्या, बैंक अकाउंट संख्या भरना अनिवार्य है I

⏩ यदि परिवार में कोई दिव्यांग सदस्य है तो डिसेबिलिटी सर्टिफिकेट भी पोर्टल पर अपलोड करना अनिवार्य है I

⏩ यदि किसी परिवार का BPL राशन कार्ड है तो उनके लिए राशन कार्ड संख्या भरना अनिवार्य है I

⏩ जिन आप्शन पर स्टार लगा हुआ है वे सभी भरने अनिवार्य हैं I

⏩ पूरा फॉर्म भरने उपरान्त फाइनल सबमिट किया जाएगा जिसे प्रिंट आउट लेकर अभिभावक के सिग्नेचर उपरान्त वापिस स्कैन करके पोर्टल पर अपलोड किया जाएगा I

⏩ इस पूरे कार्य की प्रतिदिन प्रगति रिपोर्ट सभी विद्यालय मुखिया सम्बन्धित ABRC को जमा करवाएंगे और ABRC सम्बन्धित खण्ड शिक्षा अधिकारी को प्रतिदिन रिपोर्ट जमा करवाना सुनिश्चित करेंगे I किसी भी प्रकार का गलत डाटा उपलब्ध करवाने पर सम्बन्धित विद्यालय मुखिया जिम्मेवार होंगे I

⏩ The work of family identity card will be in the same courtyard with primary / high schools. All the students who are enrol in the school premises (whether they are released from Haryana or outside Haryana) will get the first year of the school head. I'll be Nameshwari

⏩ The school leader will ensure that no more than 20 parents gather at one place on the school campus.

To get a certain distance, go to the waiting area two yards away.

 Proper arrangement of sanitizer, face mask, thermal banner and hand washing will be done at the school level and the rope should be tied at some distance from the employee doing computer related work.

 Document verification is mandatory to be done by other staff members except all technical staff

 It is mandatory for all family members above 21 years of age to fill Voter card number, bank account number.

⏩ If there is a disabled member in the family, then the disability certificate is also mandatory to be uploaded on the portal.

⏩ If a family has a BPL ration card, it is mandatory for them to fill the ration card number.

 You must fill all the stars on the map.

 Finalists will be sent after filling the complete form, which will be scanned and uploaded on the portal after the parent's signatures along with the print out.

 All the school heads will submit the progress report of the entire work to the ABRC concerned and the ABRC will submit the report daily to the concerned Block Education Officer to ensure that the school heads concerned will be promising if any wrong data is provided.

 शिशु शैक्षणिक भत्ता बारे नियम'

📍 यह भता सरकारी या गैर सरकारी  स्कूलों में पढ़ने वाले छात्रों के लिए देय है।

📍 कर्मचारी को त्रैमासिक स्वयं सत्यापित प्रमाण पत्र देना होता है। किसी प्रकार की रसीद या बिलों की जरूरत नहीं है। ट्यूशन फीस, दाखिला फीस ,लेबोरेटरी फीस ,लाइब्रेरी फीस सपोर्ट फीस, पाठ्य पुस्तक ,नोटबुक्स, वर्दी आदि के लिए यह दिया जाता है।

📍 नर्सरी से 12वीं कक्षा तक पढ़ने वाले छात्रों के लिए यह देय है।

📍यह  भत्ता पहले दो बड़े बच्चों के लिए दिया जाता है ।इसको swtich over नहीं किया जा सकता। अर्थात किसी कर्मचारी के तीन बच्चे हैं तो वह  पहले दो में से किसी का भत्ता न लेकर तीसरे का लेना चाहे तो इसकी अनुमति नहीं होती।

📍 यह त्रैमासिक ,अर्धवार्षिक या वार्षिक आधार पर निकलवाया जाता है।

📍 यदि पति व पत्नी दोनों सरकारी सेवा में हैं तो केवल एक ही अपने बच्चों के लिए यह भत्ता लेने का पात्र है।

📍 यह भत्ता सभी प्रकार की छुट्टियों व निलंबन के दौरान भी देय है।

Rules regarding infant educational allowance

 This allowance is payable to students studying in government or non-government schools.

📍 Employee has to give self attested certificate quarterly. No receipts or bills are required. This is given for tuition fees, admission fees, laboratory fees, library fees, support fees, textbooks, notebooks, uniforms etc.

It is payable for students studying from Nursery to 12th standard.

 This allowance is given for the first two older children. It cannot be swtich over. That is, if an employee has three children, then he is not allowed to take the allowance of any of the first two, and the third is not allowed.

📍 It is taken out on quarterly, half-yearly or yearly basis.

📍 If both husband and wife are in government service, only one is eligible to take this allowance for their children.

 This allowance is also payable during all types of holidays and suspension.

'RTI ACT-2005'

📍Section 8(j) के अनुसार ऐसी सूचना नहीं  दी जा सकती जिससे किसी की निजता का अतिक्रमण होता है बशर्ते की सूचना के साथ व्यापक जनहित न जुड़ा हो।

   माननीय सुप्रीम कोर्ट के अनुसार जो aspects सेवा नियमों के अधीन आते हैं वे भी पर्सनल इंफॉर्मेशन के दायरे में आते हैं।

📍 यह भी बताना उचित है माननीय सुप्रीम कोर्ट के अनुसार निजता अर्थात Privacy अब मौलिक अधिकार है।

  📍RTI Act के section -11 के अनुसार 'Third Party' पार्टी से संबंधित सूचना उसकी सहमति के बिना नहीं दी जा सकती बशर्ते कि मांगी गई सूचना से व्यापक जनहित न जुड़ा हुआ हो।

📍RTI Act के अनुसार सूचना मांगने वाले को छोड़कर सभी 'Third party' की परिधि में आते हैं।

📍Section 11(1) के अनुसार प्रार्थी के द्वारा थर्ड पार्टी से संबंधित सूचना मांगी गई है तो राज्य जन सूचना अधिकारी या केंद्रीय जन सूचना अधिकारी 5 दिन के अंदर अंदर थर्ड पार्टी को नोटिस देंगे कि आप से संबंधित जो सूचना मांगी गई है उसे डिस्क्लोज किया जाए या नहीं।

📍 राज्य जन सूचना अधिकारी या केंद्रीय जन सूचना अधिकारी से नोटिस प्राप्त करने के बाद थर्ड पार्टी दवारा 10 दिन के अंदर अंदर अपनी लिखित सहमति या असहमति कारण सहित देनी होगी।

📍 थर्ड पार्टी से संबंधित मांगी गई सूचना के बारे में थर्ड पार्टी से प्राप्त सहमति या असहमति पर निर्णय लेते हुए 40 दिन के अंदर मांगी गई सूचना या सूचना न देने का निर्णय राज्य जन सूचना अधिकारी अथवा केंद्रीय जन सूचना अधिकारी ने लेना होता है और लिए गए निर्णय की नोटिस थर्ड पार्टी को देना होगा।

📍 यदि राज्य जन सूचना अधिकारी अथवा केंद्रीय जन सूचना अधिकारी थर्ड पार्टी के विरोध के बावजूद भी उससे संबंधित सूचना को डिस्क्लोज अथवा देने का निर्णय लेते हैं तो थर्ड पार्टी को सैक्शन 19  के अनुसार इस के विरोध में प्रथम अपीलीय अधिकारी के समक्ष अपील करने का अधिकार है।

📍 यदि प्रथम अपीलीय अधिकारी भी थर्ड पार्टी के विरोध के बाद भी उससे संबंधित सूचना को डिस्क्लोज करने का फैसला लेते हैं तो उस फैसले का नोटिस थर्ड पार्टी को प्रार्थी द्वारा मांगी गई सूचना देने से पहले देना होगा और थर्ड पार्टी को राज्य जन सूचना आयोग में प्रथम अपीलीय अधिकारी के फैसले के खिलाफ अपील करने का अधिकार है।

📍 यदि राज्य सूचना आयोग भी थर्ड पार्टी से संबंधित सूचना को डिस्क्लोज करने का आदेश देते हैं, थर्ड पार्टी को माननीय हाईकोर्ट में अपील करने का अधिकार है।

RTI ACT-2005'

According to Section 8 (j), such information cannot be given which infringes on one's privacy unless the information is not comprehensively linked with public interest.

   According to the Honorable Supreme Court, the aspects which are subject to the service rules also come under the purview of personal information.

📍 It is also pertinent to state that according to the Honorable Supreme Court, privacy means that privacy is now a fundamental right.

  According to Section 11 of the RTI Act, information relating to a 'Third Party' party cannot be given without its consent provided that the information sought is not linked to the wider public interest.

According to the TIRTI Act, all except those seeking information fall within the purview of the 'third party'.

According to 11Section 11 (1), information related to third party has been sought by the applicant, then the State Public Information Officer or Central Public Information Officer will give notice to the third party within 5 days that the information related to you is sought Whether it is done or not.

बाद After receiving notice from the State Public Information Officer or Central Public Information Officer, the third party must give its written consent or disagreement with the reason within 10 days.

राज्य The decision of not giving information or information sought within 40 days is taken by the State Public Information Officer or Central Public Information Officer, while deciding on the consent or disagreement received from the third party about the information sought related to the third party. The third party will have to give notice of the decision taken.

📍 If the State Public Information Officer or the Central Public Information Officer decides to dislodge or give information related to it despite the opposition of the third party, then the third party has the right to appeal to the first appellate officer against it according to section 19 is.

📍 If the first appellate officer also decides to disclose the information related to it even after the opposition of the third party, then notice of that decision has to be given to the third party before giving the information sought by the applicant and the third party to the State Public Information Commission It has the right to appeal against the decision of the first appellate officer.

📍 If the State Information Commission also orders the disclosure of information related to the third party, the third party has the right to appeal to the Honorable High Court.

Lien , कंफर्मेशन और सीनियरटी के आपस के संबंध ।

 Master/TGT की सीनियरटी मे Principal या PGT के शामिल होने बारे सोशल मीडिया मे काफी चर्चा है,लेकिन तर्कसंगत व कानूनी सुझाव नहीं आए हैं।नियम और कानून का निष्कर्ष यह है:-Lien , कंफर्मेशन और सीनियरटी के आपस के संबंध को समझना होगा।

📍PCSR Volume -1 part-II के अनुसार कंफर्मेशन के बाद भी पूर्व पद से बिना ऑप्शन के लिएन खत्म नहीं होता था। HCS (General) Rules, 2016 के नियम 29  अनुसार  पदोन्नति के बाद प्रोबेशन पीरियड  खत्म होने पर  अर्थात 1 साल के बाद कर्मचारी को या तो अपना रिवर्नशन  करवाना होगा या फिर पदोन्नत पद पर कंफर्मेशन को स्वीकार करना होगा । इस बारे सक्षम अधिकारी द्वारा पहले नोटिस देना होगा। लेकिन आज तक भी इस नियम को लागू नहीं किया गया है।

📍 नियम 30 के अनुसार किसी स्थाई कर्मचारी का लियन वही रहेगा जिस पद पर वह कार्य कर रहा होता है।

📍 माना एक कर्मचारी A पद पर प्रथम नियुक्ति पाता है और फिर वह B पद पर पदोन्नत हो जाता है।  B पद पर कंफर्म होने से पहले ही C पद पर पदोन्नत हो जाता है। ऐसे कर्मचारी का  B पद पर कोई लीयन नहीं रह सकता। अर्थात जो पदोन्नति से टीजीटी के पद पर आए थे और टीजीटी के पद पर कंफर्म होने से पहले पीजीटी पदोन्नति गए उनका लियन टीजीटी पद पर नहीं हो सकता और न ही सीनियरिटी में नाम रह सकता। ऐसा एक फैसला मैंने माननीय हाईकोर्ट का पढ़ा है। उनका  लियन पीजीटी पद पर कंफर्म होने तक प्रथम नियुक्ति के पद पर रहेगा।

📍 इलाहाबाद हाईकोर्ट के फैसले के अनुसार किसी कर्मचारी का एक ही समय 2 पदों पर लियन नहीं हो सकता है। पदोन्नत पीजीटी को पीजीटी कैडर की सीनियरटी फिक्स हो चुकी है, लंबे समय तक इस बारे उन्होंने कोई आपत्ति भी दर्ज नहीं करवाई। ऐसे में उनकी यह सहमति मानी जा सकती है कि वे अपना लीयन PGT पद पर ही चाहते है। दो कैडरों की सीनियरटी लिस्ट में एक ही समय मौजूद  होना Service Jurisprudence के खिलाफ है।

📍 संगठन ने HCS (General) Rule,2016 के सभी प्रावधानों को लागू करवाने के लिए अंतिम तैयारी कर ली है। इन प्रयासों में तहत सभी TGTs जिनका प्रोबेशन पीरियड पूरा हो चुका है का कंफर्मेशन करवाना भी शामिल है। 20 अगस्त तक इसका परिणाम प्रदेश के शिक्षकों के सामने लाना चाहते हैं।

📍 पुराने नियमों की तुलना में नियम 2016 में कंफर्मेशन के नियम अधिक सरल  हैं। कंफर्मेशन के लिए स्थाई पद का उपलब्ध होने की शर्त नियम 2016 में हटा दी गई है। जिसके कारण प्रोबेशन अवधि पूरी होते ही सक्षम अधिकारी ने कंफर्मेशन के आदेश पारित करने का  प्रावधान है।

There is a lot of discussion in social media about the inclusion of Principal or PGT in Seniority of Master / TGT, but rational and legal suggestions have not come up. The conclusion of the rule and law is: - Lien, Confirmation and Seniority's relation has to be understood. .

According to 📍PCSR Volume-1 Part-II, even after confirmation, the former position did not end without options. As per Rule 29 of HCS (General) Rules, 2016, after the end of the probation period after promotion, that is, after 1 year, the employee must either get his reversion or accept the confirmation to the promoted post. A notice will have to be given by the competent authority first. But even today, this rule has not been implemented.

📍 According to Rule 30, the lien of a permanent employee will remain the same position he is working on.

📍 Suppose an employee gets first appointment at A post and then gets promoted to B post. One gets promoted to C post before he can get confirmed at B post. Such employee cannot have any lien in B post. That is, those who came to the post of TGT from promotion and who were promoted to PGT before being confirmed to the post of TGT cannot have lien in TGT post and cannot be named in seniority. I have read one such decision of the Honorable High Court. His lien will remain on the post of first appointment until he is confirmed on the post of PGT.

 According to the decision of Allahabad High Court, an employee cannot have lien on 2 posts at the same time. The promoted PGT has been fixed by the seniority of the PGT cadre, for a long time they have not even lodged any objection. In such a situation, it can be considered that they want their Lion in PGT post only. The presence of two cadres in the seniority list at the same time is against Service Jurisprudence.

📍 The organization has made final preparations to implement all the provisions of HCS (General) Rule, 2016. These efforts also include getting all TGTs whose probation period has been completed. We want to bring this result to the teachers of the state by 20 August.

 Confirmation rules in Rule 2016 are much simpler than the old rules. The condition of availability of permanent post for confirmation has been removed in the rules 2016. Due to which the competent officer has the provision to pass the order of confirmation as soon as the probation period is over.

📍PCSR Volume -1 part-II के कंफर्मेशन के बाद भी पूर्व पद से बिना ऑप्शन के लिएन खत्म नहीं होता था।CSR (General) Rules, 2016 के अनुसार लियन वही रहेगा जिस पद पर कार्य कर रहा है। पदोन्नति के बाद 1 साल के बाद कर्मचारी को या तो अपना रिवर्नशन  करवाना होगा या फिर पदोन्नत पद पर कंफर्मेशन को स्वीकार करना होगा।

📍 इन नियमों को अभी तक कहीं पर भी लागू नहीं किया जा रहा।

📍 हरियाणा मास्टर वर्ग एसोसिएशन इन नियमों को लागू करवाने के लिए प्रयासरत है और इसी महीने इस नियम        को लागू करवा दिया जाएगा।

📍 31 अगस्त तक ही 250 ESHM सेवानिवृत्त हो रहे हैं।

📍 लगभग 750 और हाई स्कूल हेडमास्टरों  की पदोन्नति हर हाल में आगामी डेढ़ महीने के अंदर हो जाएगी।

📍 सगठन मौलिक शिक्षा के लिए अलग से पदोन्नति की लाइन पर जोर देने जा कर रहा है।

📍 इसी महीने के अंत तक कंफर्मेशन की प्रक्रिया को पूर्ण करवा दिया जाएगा।

📍 रशनेलाइजेशन में मनमाने तरीके से पदों को ब्लॉक करने तथा शिक्षा के मौलिक अधिकार की उल्लंघन की             अनुमति नहीं दी जाएगी।

📍 सभी पीजीटी पदों पर सितंबर के अंत तक पदोन्नति या करवा दी जाएंगी।

📍 सगठन मौजूदा नियमों को लागू करवाने के लिए प्रयासरत है और हाई स्कूल हेडमास्टर के पदों पर काफी हद तक लागू दिए हुए हैं। Catch up rule वह भी इसी महीने लागू करवाने का प्रयास किया जा रहा है।

📍 आपके प्रयासों से संगठन चाहता है कि हरियाणा मास्टर वर्ग एसोसिएशन कक्षा 6 से 8 के प्रत्येक अध्यापक का लोकप्रिय संगठन बने।

📍 मौलिक स्कूल मुख्याध्यापक को पूर्णकालिक व द्वितीय श्रेणी का दर्जा बारे संगठन चाहता है कि आगामी 2 महीने के अंदर अंदर इसका परिणाम दे दिया जाए।

📍 रशनेलाइजेशन म़े हरियाणा मास्टर वर्ग एसोसिएशन 36 छात्र होते ही दूसरा सेक्शन बनवाने पर जोर देगी और इस बारे हम कामयाब रहेंगे। मौलिक स्कूल मुख्याध्यापक ओं को पूर्ण कार्यभार देने से कोई भी शिक्षक सर प्लस नहीं होना चाहिए इसके लिए हरियाणा मास्टर वर्ग एसोसिएशन मौलिक स्कूल मुख्याध्यापक को पूर्णकालिक का दर्जा दिलवाने के लिए सभी प्रयास कर रही है।

चंडीगढ़। हरियाणा के मुख्यमंत्री  मनोहर लाल ने स्थानांतरण नीति में रक्षा बंधन के अवसर पर महिला कर्मचारियों को स्टेशन का विकल्प चुनते समय एक बड़ी राहत प्रदान की। जिसके तहत अविवाहित या तलाकशुदा या विधवा महिला कर्मचारी को अब पहले ‘जनरल ट्रांसफर ड्राइव’ में भाग लेने की आवश्यकता नहीं होगी। ऐसे मामलों में विवाह के बाद उनसे विकल्प मांगा जाएगा तथा नवविवाहिता या अन्य उक्त श्रेणी की महिला कर्मचारियों को उसके विकल्प के अनुसार तीन वर्ष के लिए पहला स्टेशन दिया जाएगा।

मुख्यमंत्री आज यहां विभिन्न विभागों की तैयार की जा रही ‘ऑनलाइन स्थानांतरण नीति’ की समीक्षा के लिए बुलाई गई बैठक की अध्यक्षता कर रहे थे।

मुख्यमंत्री द्वारा लिए गए निर्णय के अनुसार विवाह उपरांत, नवविवाहित/तलाकशुदा के मामले में उसके पहले विकल्प का स्टेशन तीन वर्षों तक दिया जाएगा। उसके बाद महिला कर्मचारी यदि ट्रांसफर ड्राइव में भाग लेती है तो उसके विकल्प के अनुसार पहला,दूसरा या तीसरा स्टेशन दिया जाएगा। इसी प्रकार, शत-प्रतिशत दिव्यांग या 80 प्रतिशत लोकोमोटिव दिव्यांग कर्मचारी को स्थानांतरण नीति के अनुसार पहली पसंद का स्टेशन ही दिया जाएगा।  

बैठक में मुख्यमंत्री ने निर्देश दिए कि सभी प्रशासनिक सचिव अध्यापक ऑनलाइन स्थानांतरण नीति को आधार मानकर अपने विभाग में 500 से अधिक कर्मचारियों की ऑनलाइन स्थानांतरण नीति मुख्य सचिव कार्यालय से 31 अगस्त,2020 से पहले-पहले अनुमोदित करवा लें। कर्मचारी की सहमति लेने उपरांत तीन दिन तक विकल्प देने के लिए पोर्टल खोला जाएगा। जिन विभागों में कर्मचारियों से विकल्प मांगने की प्रक्रिया पूरी हो चुकी है प्रशासनिक सचिव अगस्त माह में किसी भी समय कर्मचारी का ऑनलाइन स्थानांतरण कर सकते हैं। मुख्यमंत्री ने कहा कि अगर प्रशासनिक सचिव चाहे तो 500 से कम अर्थात 400 या 300 तक के कर्मचारियों की संख्या वाले विभागों के लिए भी ऑनलाइन स्थानांतरण नीति तैयार कर सकते हैं।

मुख्यमंत्री ने स्पष्टï किया कि ऑनलाइन स्थानांतरण के मामले में जहां नीति में छूट देकर स्थानांतरण किए गए हैं वे केवल अस्थाई दो या तीन महीने के लिए ही हैं और जैसे ही शैक्षणिक सत्र समाप्त होता है तो उन्हें ड्राइव में भाग लेना अनिवार्य होगा। नीति के अनुसार प्रत्येक कर्मचारी को हर वर्ष विकल्प भरने होंगे और उसकी वरिष्ठïता अंकों के आधार पर दिए गए विकल्प के अनुरूप स्टेशन दिए जाएंगे। इसी प्रकार, कर्मचारी को अचानक किडनी की समस्या या दिल की बीमारी हो जाने पर, संबंधित जिला उपायुक्त, एसएमओ व संबंधित विभाग का जिलाध्यक्ष की कमेटी उस कर्मचारी की मेडिकल हिस्ट्री का ब्यौरा पोर्टल पर लोड करेगी, जो कर्मचारी के एचआरएमएस से लिंक किया जाएगा। ऐसे मामलों में कमेटी के लिए अलग से नया पोर्टल खोला जाएगा।  

मुख्यमंत्री ने आज जिन विभागों की ऑनलाइन स्थानांतरण नीति की समीक्षा की। उनमें कृषि एवं किसान कल्याण, सहकारिता, हरियाणा राज्य कृषि विपणन बोर्ड, विकास एवं पंचायत, लोक निर्माण (भवन एवं सडक़ें), परिवहन, कौशल विकास एवं औद्योगिक प्रशिक्षण संस्थान, आबकारी एवं कराधान, पशुपालन एवं डेयरी तथा बिजली विभाग शामिल थे।

बैठक में प्रशासनिक सचिवों ने मुख्यमंत्री को आश्वासन दिया कि आपके दिशानिर्देशानुसार विभागों की ऑनलाइन स्थानांतरण नीति का ड्राफ्ट मुख्य सचिव कार्यालय से 31 अगस्त,2020 से पहले-पहले अनुमोदित करवा लिया जाएगा। मुख्यमंत्री को अवगत कराया कि कृषि एवं किसान कल्याण विभाग के कृषि विकास अधिकारी (एडमिन काडर) व फील्ड मैन का पहली सितम्बर,2020 से, हरियाणा राज्य कृषि विपणन बोर्ड के ऑक्शन रिकार्डर के लिए 15 अगस्त से, पशुपालन पालन विभाग वीएलडीए व पशु चिकित्सक का 30 अगस्त से, पंचायत एवं विकास विभाग ग्राम सचिव एवं कनिष्ठï अभियंता का 16 से 20 अगस्त के बीच, आबकारी एवं कराधान विभाग के लिपिक एवं सेवादार का 20 अगस्त से, स्कूल शिक्षा विभाग के लिपिक वर्ग के लिए 13 अगस्त से ऑनलाइन ट्रांसफर आरंभ कर दिया जाएगा।

 इसी प्रकार, लोक निर्माण (भवन एवं सडक़ें) विभाग के कनिष्ठï अभियंता (सिविल) का 15 अगस्त से, सहकारिता विभाग (आरसीएस) के उप-निरीक्षक सामान्य का 15 अगस्त से, परिवहन विभाग के चालकों व परिचालकों का पहली अगस्त,2020 से व लिपिक तथा निरीक्षक का 20 अगस्त से पहली सितम्बर तक, महिला एवं बाल विकास विभाग सुपरवाइजर (महिला) किसी भी समय अगले कार्य दिवस या पांच अगस्त से, उच्चतर शिक्षा विभाग के एसिस्टेंट/एसोसिएट प्रोफेसर (अंग्रेजी व वाणिज्य) का 20 अगस्त से ऑनलाइन ट्रान्सफर आरंभ कर दिया जाएगा जबकि बिजली निगमों के कनिष्ठï अभियंता, एलडीसी व यूडीसी का ट्रान्सफर धान सीजन के बाद अक्तूबर में आरंभ किया जाएगा।

बैठक में मुख्य सचिव केशनी आनन्द अरोड़ा, मुख्यमंत्री के प्रधान सचिव राजेश खुल्लर, कृषि एवं किसान कल्याण विभाग के अतिरिक्त मुख्य सचिव  संजीव कौशल, स्कूल शिक्षा विभाग के अतिरिक्त मुख्य सचिव डॉ. महावीर सिंह, महिला एवं बाल विकास विभाग के अतिरिक्त मुख्य सचिव अमित झा, मुख्यमंत्री के अतिरिक्त प्रधान सचिव वी.उमाशंकर व मुख्यमंत्री की उप-प्रधान सचिव श्रीमती आशिमा बराड़, आबकारी एवं कराधान विभाग के प्रधान सचिव  अनुराग रस्तोगी, विकास एवं पंचायत विभाग के प्रधान सचिव श्री सुधीर राजपाल, उच्चतर शिक्षा विभाग के प्रधान सचिव श्री अंकुर गुप्ता के अलावा अन्य अधिकारी भी उपस्थित थे।

                                      Need to participate in 'General Transfer Drive'

Chandigarh Haryana Chief Minister Manohar Lal provided a major relief to women employees while opting for the station on the occasion of Raksha Bandhan in the transfer policy. Under which unmarried or divorced or widowed female employees will no longer be required to participate in the first 'General Transfer Drive'. In such cases, they will be asked for an option after marriage and the newly married or other female employees of the above category will be given the first station for three years as per their option.

The Chief Minister was presiding over a meeting called to review the online transfer policy being prepared by various departments here today.

As per the decision taken by the Chief Minister, in case of newly married / divorced after marriage, the station of its first option will be given for three years. After that if the female employee participates in the transfer drive, the first, second or third station will be given as per her option. Similarly, 100 percent disabled or 80 percent locomotive disabled employees will be given the station of first choice as per the transfer policy.

At the meeting, the Chief Minister directed that all administrative secretaries should take the online transfer policy as the basis of the online transfer policy and get the online transfer policy of more than 500 employees in their department approved by the Chief Secretary Office before August 31, 2020. After obtaining the consent of the employee, the portal will be opened for giving options for three days. In the departments where the process of seeking the option from the employees has been completed, the Administrative Secretary can transfer the employee online at any time in August. The Chief Minister said that if the Administrative Secretary wishes, he can also prepare an online transfer policy for departments with a workforce of less than 500 i.e. 400 or 300.

The Chief Minister clarified that in case of online transfers, where the transfers have been done by giving relaxation in the policy, they are only for temporary two or three months and as soon as the academic session ends, they will be required to participate in the drive. As per the policy, every employee has to fill the option every year and stations will be given according to the option given on the basis of his seniority marks. Similarly, in case of sudden kidney problem or heart disease to the employee, the concerned Deputy Commissioner, SMO and the District Headquarters Committee of the concerned department will load the details of the medical history of the employee, which will be linked to the employee's HRMS. In such cases, a new portal will be opened for the committee.

The Chief Minister today reviewed the online transfer policy of the departments. They included Agriculture and Farmers Welfare, Cooperatives, Haryana State Agricultural Marketing Board, Development and Panchayats, Public Works (Building and Roads), Transport, Skill Development and Industrial Training Institutes, Excise and Taxation, Animal Husbandry and Dairy and Electricity Departments.

At the meeting, the Administrative Secretaries assured the Chief Minister that the draft of the online transfer policy of the departments would be got approved by the Chief Secretary's office before August 31, 2020, according to your guidelines. The Chief Minister apprised that the Agricultural Development Officer (Admin cadre) and Field Man of the Department of Agriculture and Farmers Welfare from 1st August, 2020, for the Auction Recorder of Haryana State Agricultural Marketing Board from August 15, Animal Husbandry Department VLDA and Veterinarian From August 30, the Panchayat and Development Department started the online transfer of the village secretary and junior engineer from August 16 to 20, the clerk and serviceman of the Excise and Taxation department from August 20, the clerk of the School Education Department from August 13. Will go.

तदर्थ सेवा का सीनियरिटी के लिए गणना I

                                 

                   तदर्थ सेवा का  सीनियरिटी के लिए गणना करने के लिए माननीय सुप्रीम कोर्ट के विभिन्न फैसलों का निष्कर्ष इस प्रकार है:

1.    कैडर में जन्म से पहले सीनियरिटी क्लेम नहीं की जा सकती। कैडर में जन्म नियमित नियुक्ति के साथ होता है।

2.     यदि तदर्थ नियुक्ति अप्वाइंटिंग अथॉरिटी द्वारा की गई हो और बिना किसी पर ब्रेक के बाद में सेवा रैगुलर हो जाती है तो कर्मचारी को Adhoc नियुक्ति तिथि से ही नियमित माना जाएगा और एडवोक सर्विस सीनियरिटी में काउंट होगी। जैसे मास्टर और लेक्चरर की अप्वाइंटिंग अथॉरिटी ज्वाइंट डायरेक्टर अथवा एडीशनल डायरेक्टर अथवा डायरेक्टर है । लेक्चरर के लिए  द्वितीय श्रेणी बनने से पहले Director  महोदय अप्वाइंटिंग अथॉरिटी थे। जिला  शिक्षा अधिकारी  या जिला मौलिक शिक्षा अधिकारी मास्टर और लेक्चरर की  अप्वाइंटिंग अथॉरिटी नहीं हैं। सुप्रीम कोर्ट की इस रूलिंग का  लाभ c&v कैडर के अध्यापक केवल अलग से याचिका लगा कर ले सकते हैं। मास्टर या      लेक्चरर की तदर्थ नियुक्ति यदि निदेशालय से हुई है तो वह भी इसके लिए कानूनी लड़ाई लड़ सकते हैं।

3.   यदि सरकार का कोई पत्र या संबंधित सेवा नियम तदर्थं सेवा  का लाभ सीनियरिटी काउंट करने में देते हैं तो भी एडहॉक सेवा का लाभ के लिए कानूनी लड़ाई लड़ सकते हैं। जैसे असिस्टेंट प्रोफेसर के मामले में है। असिस्टेंट प्रोफेसर से संबंधित फैसलों का लाभ मास्टर c&v अध्यापक और स्कूल लेक्चरर नहीं ले सकते. असिस्टेंट प्रोफेसर के फैसलों के आधार पर अदालत में जाने से हमें नहीं लगता कोई लाभ होगा I

The conclusion of various decisions of the Hon'ble Supreme Court to calculate adhoc service for seniority is as follows:

1. Seniority cannot be claimed before birth in the cadre. Birth in the cadre takes place with regular appointment.

2. If the ad hoc appointment is made by the appointing authority and the service becomes regular without any break after the break, the employee will be treated as regular from the adhoc appointment date and counted in the Advoc Service seniority. For example, the appointing authority of master and lecturer is joint director or additional director or director. The Director was the appointing authority before becoming a second class for lecturers. The District Education Officer or District Basic Education Officer is not the appointing authority of master and lecturer. The teachers of the c & v cadre can take advantage of this ruling of the Supreme Court only by applying a separate petition. If the ad hoc appointment of master or lecturer is done from the directorate, then they can also fight a legal battle for it.

3. Even if a government letter or related service rules give the benefit of adhoc service to seniority count, adhoc can still fight a legal battle for the benefit of service. As is the case with Assistant Professor. Master c & v teachers and school lecturers cannot take advantage of decisions related to assistant professor. Going to court based on the decisions of Assistant Professor, we do not think there will be any benefit.

अध्यापकों के एसीपी के मामलों पर नीलम रानी के फैसले के तहत एरियर लिए जाने का एतराज I

                     अध्यापकों के एसीपी के  मामलों पर नीलम रानी के फैसले के तहत एरियर लिए जाने का एतराज लगाया जा रहा है। इसमें कहा जा रहा है की अध्यापक ने सेवा पंजिका के पेज नंबर.... नीलम रानी कि फैसले के तहत एरियर लिया हुआ है। इसलिए कर्मचारी के  वेतन की 7 फरवरी 2019 की अधिसूचना के तहत समीक्षा की जाए।

           उल्लेखनीय है कि यदि कर्मचारी का वेतन 7 फरवरी 2019 की अधिसूचना के अनुसार फिक्स किया जाता है तो उसके द्वारा लिए जा रहे वेतन कोई अंतर नहीं आता। रिकवरी की कोई संभावना नहीं है।

     इसलिए जिन अध्यापकों के एसीपी के मामलों पर उपरोक्त प्रकार का एतराज लगा है वे अपनी सेवा पंजिका में इस प्रकार की प्रविष्टि कर फिर  से मामले को स्वीकृति हेतु भेजें। सेवा पंजिका में जो पृविष्टि करनी है वो इस प्रकार है:

'  अध्यापक ने नीलम रानी के मामले में एरियर लिया हुआ है। जिसकी प्रविष्टियां सेवा पंजिका के पेज नंबर...... की हुई है। सेवा पंजिका में वेतन संबंधी सभी प्रविष्टियों की 7 फरवरी 2019 की अधिसूचना के अनुसार पूर्व अवलोकन अथवा समीक्षा कर ली गई है। कर्मचारी द्वारा लिए जा रहे मूल वेतन में कोई अंतर नहीं आता है। मूल वेतन संबंधी सभी प्रविष्ठियां सही है।'

 इस प्रकार की प्रविष्टि से विभाग द्वारा लगाए गए एतराज की अनुपालना हो जाती है। एसोसिएशन ने निदेशक महोदय से अनुरोध किया है कि भविष्य में इस प्रकार के एतराज न लगाए जाएं।

           कोरोना के जो सामान्य  लक्षण जुकाम, खांसी,गला बंद होना बताये जाते हैं ऐसा मुझमें कुछ नहीं  था I

पिछले कुछ समय से पेट के निचले हिस्से में में दर्द था , जिसे मैं नार्मल लेकर चलती रही..डाक्टर ने भी अल्ट्रासाउंड करके कोई खास दिक्कत नहीं बताई और मैडिसन दे दी ।इसके बाद पेट के अंदर तुफान सा मच कर तेज दर्द के साथ पुरे शरीर में पसीने आने लगे तब दोबारा मैडिकल गई तो Covid-19 test करवाने के लिये लिखा जो पोजिटिव आया।

07/07/2020 तारीख रात 11:30  पर फोन आया आपका कोरोना टैस्ट पोजिटिव है I आपको घर से ऐंबुलेंस में लेने आ रहे हैं I पूरा परिवार सन्न रह गया I बच्चों के चेहरे देखने लायक थे I एक बार मुझे भी घबराहट हुई, फिर मैंने हंस कर कहा मुझे कुछ नहीं होगा । मैं इतनी जल्दी  तुम्हारा पीछा नहीं छोड़ने वाली। मेरी बात पर कोई नहीं हंसा , उनकी चिंता जायज थी क्योंकि मैं हार्ट पेशेंट भी हुं।

मैंने कहा आप रहने दीजिए , मैं खुद ही मैडिकल आती हुं और मैं पंहुच गई।दो दिन रखकर कुछ ज्यादा दिक्कत नहीं लगी तो घर भेज दिया।

अगले दिन लूज मोशन के साथ पेट दर्द, दम सा घुटना, पसीने आना, शरीर शिथिल पड़ना I ऐसा बार बार होने लगा तो मैंने मैडिकल फोन कर दिया। ऐंबुलेंस मुझे लेने आ गई और मैं अकेले ही बच्चों से ये कहकर कि अपना ख्याल रखना, मैं जल्द वापिस आ रही हुं।

यंहा आकर पता चला लोग 25-30 दिन तक के भी यंही हैं क्योंकि उनका टैस्ट बार-बार पोजिटिव आ रहा है , तब  खुशी से यह स्वीकार कर लिया कि महीने बीस दिन के लिए यही मेरा घर हैं । सुबह मैडिकल आई तब भी ऐंबुलेंस में बैठते ही अपना ओनलाईन शिक्षण शुरू कर दिया । मैडिकल पंहुच कर भी फेसबुक,वाटसएप.फोन के जवाब देने मे अपने आप को इतना व्यस्त कर लिया जैसे कुछ हुआ ही नहीं।

तीन चार दिन तक जब भी दिक्कत बढ़े तो मैं अंदर ही अंदर मुस्कुराने लग जाऊं कि मुझे कुछ नहीं होगा। मैं अकेले पिकनिक पर आई हुं और खुशी-खुशी वापिस जाऊंगी फिर धीरे-धीरे दर्द कम होता गया।

और कल 11 दिन बाद दोबारा टैस्ट हुआ जिसकी रिपोर्ट निगेटिव आई हैं । सभी शुभचिंतक और मेरे परिवार की दुआओं से आज मैं घर वापिस आ जाऊँगी।

After this, the entire body was filled with severe pain after becoming a storm in the stomach. When I started sweating, I went to medical again and wrote to get Covid-19 test, which came positive.

You got a call on 07/07/2020 at 11:30 pm. Your corona test is positive. You are coming from home to take an ambulance. The whole family was stunned. The faces of the children were worth seeing. Once I got nervous too, then I laughed and said nothing would happen to me. I am not going to leave you so soon. Nobody laughed at my point, their concern was justified because I am also a heart patient.

I said let it be, I come to the medical myself and I reached. After two days there was not much problem, then sent home.

The next day, with loose motion, stomach ache, suffocation, sweating, body slackness. I started to call the medical again and again. The ambulance came to pick me up and I was coming back soon after telling the children alone to take care of myself.

People came here and came to know that they are here for 25-30 days because their test is coming again and again, then happily accepted that this is my home for twenty months. Medical came in the morning, even after sitting in an ambulance, started his online education. Even after getting medical access, he got himself so busy answering Facebook, WhatsApp.phone as if nothing had happened.

For three to four days whenever the problems escalate, I start smiling inside myself that nothing will happen to me. I have come alone on a picnic and will happily return, then slowly the pain subsides.

And yesterday, after 11 days, there was another test, whose reports have been negative. With all the well wishers and my family's blessings, I will return home today.
