Lien , कंफर्मेशन और सीनियरटी के आपस के संबंध ।

 Master/TGT की सीनियरटी मे Principal या PGT के शामिल होने बारे सोशल मीडिया मे काफी चर्चा है,लेकिन तर्कसंगत व कानूनी सुझाव नहीं आए हैं।नियम और कानून का निष्कर्ष यह है:-Lien , कंफर्मेशन और सीनियरटी के आपस के संबंध को समझना होगा।

📍PCSR Volume -1 part-II के अनुसार कंफर्मेशन के बाद भी पूर्व पद से बिना ऑप्शन के लिएन खत्म नहीं होता था। HCS (General) Rules, 2016 के नियम 29  अनुसार  पदोन्नति के बाद प्रोबेशन पीरियड  खत्म होने पर  अर्थात 1 साल के बाद कर्मचारी को या तो अपना रिवर्नशन  करवाना होगा या फिर पदोन्नत पद पर कंफर्मेशन को स्वीकार करना होगा । इस बारे सक्षम अधिकारी द्वारा पहले नोटिस देना होगा। लेकिन आज तक भी इस नियम को लागू नहीं किया गया है।

📍 नियम 30 के अनुसार किसी स्थाई कर्मचारी का लियन वही रहेगा जिस पद पर वह कार्य कर रहा होता है।

📍 माना एक कर्मचारी A पद पर प्रथम नियुक्ति पाता है और फिर वह B पद पर पदोन्नत हो जाता है।  B पद पर कंफर्म होने से पहले ही C पद पर पदोन्नत हो जाता है। ऐसे कर्मचारी का  B पद पर कोई लीयन नहीं रह सकता। अर्थात जो पदोन्नति से टीजीटी के पद पर आए थे और टीजीटी के पद पर कंफर्म होने से पहले पीजीटी पदोन्नति गए उनका लियन टीजीटी पद पर नहीं हो सकता और न ही सीनियरिटी में नाम रह सकता। ऐसा एक फैसला मैंने माननीय हाईकोर्ट का पढ़ा है। उनका  लियन पीजीटी पद पर कंफर्म होने तक प्रथम नियुक्ति के पद पर रहेगा।

📍 इलाहाबाद हाईकोर्ट के फैसले के अनुसार किसी कर्मचारी का एक ही समय 2 पदों पर लियन नहीं हो सकता है। पदोन्नत पीजीटी को पीजीटी कैडर की सीनियरटी फिक्स हो चुकी है, लंबे समय तक इस बारे उन्होंने कोई आपत्ति भी दर्ज नहीं करवाई। ऐसे में उनकी यह सहमति मानी जा सकती है कि वे अपना लीयन PGT पद पर ही चाहते है। दो कैडरों की सीनियरटी लिस्ट में एक ही समय मौजूद  होना Service Jurisprudence के खिलाफ है।

📍 संगठन ने HCS (General) Rule,2016 के सभी प्रावधानों को लागू करवाने के लिए अंतिम तैयारी कर ली है। इन प्रयासों में तहत सभी TGTs जिनका प्रोबेशन पीरियड पूरा हो चुका है का कंफर्मेशन करवाना भी शामिल है। 20 अगस्त तक इसका परिणाम प्रदेश के शिक्षकों के सामने लाना चाहते हैं।

📍 पुराने नियमों की तुलना में नियम 2016 में कंफर्मेशन के नियम अधिक सरल  हैं। कंफर्मेशन के लिए स्थाई पद का उपलब्ध होने की शर्त नियम 2016 में हटा दी गई है। जिसके कारण प्रोबेशन अवधि पूरी होते ही सक्षम अधिकारी ने कंफर्मेशन के आदेश पारित करने का  प्रावधान है।

There is a lot of discussion in social media about the inclusion of Principal or PGT in Seniority of Master / TGT, but rational and legal suggestions have not come up. The conclusion of the rule and law is: - Lien, Confirmation and Seniority's relation has to be understood. .

According to 📍PCSR Volume-1 Part-II, even after confirmation, the former position did not end without options. As per Rule 29 of HCS (General) Rules, 2016, after the end of the probation period after promotion, that is, after 1 year, the employee must either get his reversion or accept the confirmation to the promoted post. A notice will have to be given by the competent authority first. But even today, this rule has not been implemented.

📍 According to Rule 30, the lien of a permanent employee will remain the same position he is working on.

📍 Suppose an employee gets first appointment at A post and then gets promoted to B post. One gets promoted to C post before he can get confirmed at B post. Such employee cannot have any lien in B post. That is, those who came to the post of TGT from promotion and who were promoted to PGT before being confirmed to the post of TGT cannot have lien in TGT post and cannot be named in seniority. I have read one such decision of the Honorable High Court. His lien will remain on the post of first appointment until he is confirmed on the post of PGT.

 According to the decision of Allahabad High Court, an employee cannot have lien on 2 posts at the same time. The promoted PGT has been fixed by the seniority of the PGT cadre, for a long time they have not even lodged any objection. In such a situation, it can be considered that they want their Lion in PGT post only. The presence of two cadres in the seniority list at the same time is against Service Jurisprudence.

📍 The organization has made final preparations to implement all the provisions of HCS (General) Rule, 2016. These efforts also include getting all TGTs whose probation period has been completed. We want to bring this result to the teachers of the state by 20 August.

 Confirmation rules in Rule 2016 are much simpler than the old rules. The condition of availability of permanent post for confirmation has been removed in the rules 2016. Due to which the competent officer has the provision to pass the order of confirmation as soon as the probation period is over.
